Legal

Full terms

These Terms of Service (the "Terms") govern your access to and use of https://carturf.com, related websites, and the vehicle registration, insurance facilitation, and related services offered through CarTurf (collectively, the "Services").

The Services are provided by CARTURF GLOBAL - FZCO ("CarTurf," "we," "us," or "our"), a free zone company established in Dubai, United Arab Emirates (IFZA, license TL 64196). For the purposes of these Terms, "Customer," "you," and "your" mean the individual or entity that contracts for the Services.

CarTurf may subcontract performance of local registration, dealership, storage, logistics, and related operational tasks to licensed partner entities, including CarTurf UG (haftungsbeschränkt) (HRB 29662, Koblenz), with its German partner office at Dieselstraße 28, 53424 Remagen, Germany, and other partners as CarTurf expands. Subcontracting does not change that your customer contract for the Services is with CarTurf Global FZCO, unless a separate written agreement expressly states otherwise.

1. Services Provided

CarTurf agrees to provide the Customer with consultation and assistance in locating, purchasing, insuring, and registering a vehicle through CarTurf's partner network in Europe. These services are advisory and facilitative in nature, and final purchase decisions remain with the Customer.

By signing up for the Services, the Customer authorizes CarTurf and its licensed partners to register and insure the Customer's vehicle in the name of the applicable partner entity acting as registered keeper (Halter) where that structure applies under local law. Associated costs, including insurance premiums and vehicle tax, are the Customer's responsibility as invoiced.

2. Representation, Registered Keeper, and Liability

Where applicable under local law (including German law for German registrations), CarTurf's licensed partner acts as the registered keeper (Halter) of the vehicle for registration, insurance, and vehicle-tax purposes. Ownership of the vehicle remains with the Customer at all times, as evidenced by the purchase agreement and related ownership documents.

The Customer agrees to fully indemnify CarTurf and its partners from legal claims, penalties, fines, or damages arising from the operation, use, or misuse of the vehicle by the Customer or any person the Customer permits to drive the vehicle.

The Customer authorizes CarTurf and its partners to handle matters related to registration, insurance, and vehicle tax with the competent registration office, insurer, and tax authorities, including registering, deregistering, re-registering, insuring, and related changes, in accordance with the Customer's instructions and these Terms. CarTurf will issue written notice of material changes affecting the registration, provided the Customer does not have amounts owed to CarTurf that are more than fourteen (14) days overdue.

3. Retention of Vehicle Registration Document Part II (Zulassungsbescheinigung Teil II / Fahrzeugbrief)

Where a German registration is used, the Customer acknowledges that the performing partner (typically CarTurf UG) will retain physical possession of the Zulassungsbescheinigung Teil II (Vehicle Registration Certificate Part II / Fahrzeugbrief) for the duration of the registration under that partner.

Under German law, the Zulassungsbescheinigung Teil II documents registration status and does not constitute proof of ownership. Ownership remains with the Customer. Retention of the document does not transfer ownership rights.

Retention serves administrative and legal compliance for the registered keeper and as security for outstanding obligations owed to CarTurf or its partners. Upon deregistration and confirmation that all outstanding balances have been settled, CarTurf (or its partner) will release the Fahrzeugbrief to the Customer or a designated third party in accordance with applicable law.

4. Customer Responsibility: Traffic Laws, Tolls, and Route Planning

The Customer (as owner and operator of the vehicle) agrees and obligates themselves to abide by all traffic rules, road laws, and regulations while using a vehicle registered through CarTurf, in every country and area where the vehicle is driven.

It is the Customer's and any permitted driver's sole responsibility to educate themselves on which countries and areas require payment for toll roads, paid crossings, toll bridges, tunnels, environmental or congestion zones, and similar charges, and to study their route beforehand. Any violation or fine resulting from a failure to be aware of or pay such charges is the Customer's sole responsibility.

The Customer is responsible for ensuring they possess a valid driver's license and, if required by local law, an International Driving Permit or other required documentation. CarTurf is not responsible for informing the Customer of every licensing requirement in every jurisdiction.

The Customer further agrees to maintain a valid safety and emissions inspection for the vehicle at all times, preferably from an EU country. If the vehicle's inspection expires while the Customer is outside the country of registration and the Customer returns to that country, the Customer agrees to complete the required inspection within seven (7) days of re-entry as needed to keep the vehicle road-legal.

5. Traffic Violations, Fines, and Administrative Processing

5.1 Full responsibility

The Customer takes full responsibility for any violations, fines, penalties, and consequences arising while the vehicle is in the Customer's possession or while it is driven by anyone the Customer permits to drive the vehicle. This includes parking, speeding, toll, and other road-authority notices addressed to the registered keeper.

5.2 Payment and charging authorization

If any fine or related cost remains outstanding for more than seven (7) days after CarTurf notifies the Customer (or after the amount otherwise becomes due under CarTurf's notice), the Customer hereby consents to CarTurf charging the payment method on file with CarTurf to cover such costs, including the underlying fine and any applicable processing fees under Section 5.4.

5.3 Disputes

The Customer may dispute a violation with CarTurf by providing proof of payment or other exonerating evidence (for example, proof of parking payment or toll-road access) within a reasonable time after notice. If no adequate proof is produced within that time, the Customer must pay the fine and related costs.

5.4 Processing fees

CarTurf will process one (1) fine or violation notice per calendar month at no additional processing charge to the Customer. If the Customer incurs multiple fines or violation notices in the same calendar month, each fine and notice after the first will be processed by CarTurf at an additional charge of €15 per incident.

5.5 Identity documents for authorities

If a road authority requires information on the driver at the time of a violation, the Customer is obligated to submit their identity document (and, where requested, a valid address) promptly when requested by CarTurf. Failure to provide required information may result in additional penalties for which the Customer remains solely responsible.

5.6 Permitted drivers — documents before access

Before granting any other person access to drive the vehicle, the Customer agrees to provide CarTurf with a copy of that person's identity document and driver's license. The Customer remains fully responsible for that driver's compliance with these Terms and all applicable laws.

6. Insurance and Vehicle Tax Payment; Deregistration for Non-Payment

The Customer agrees to pay invoices for vehicle insurance and vehicle tax within seven (7) days of the invoice being issued by CarTurf.

If an invoice for vehicle insurance or vehicle tax remains unpaid for more than fourteen (14) days, CarTurf reserves the right to deregister the vehicle. After deregistration, insurance typically becomes invalid and the vehicle must be parked off public roads and must not be driven. CarTurf will inform the Customer in writing via email and/or CarTurf in-app messaging of the impending deregistration before it takes effect, except where immediate action is required by law or by an authority.

CarTurf will not be held responsible for any damage the driver causes, or that the vehicle causes, after deregistration. From deregistration onward, the owner becomes solely responsible for any damage caused by the vehicle and for keeping it off public roads until it is lawfully re-registered and insured.

In the event of non-payment for more than fourteen (14) days on any amounts owed to CarTurf, a late fee of five percent (5%) of the overdue amount may be assessed each month until paid in full, in addition to CarTurf's other rights under these Terms.

The Customer may request proof of payment for insurance premiums, vehicle taxes, or related expenses that CarTurf has paid on the Customer's behalf.

7. Limitation of Liability

To the fullest extent permitted by law, CarTurf and its partners and suppliers shall not be liable for losses, damages, or costs arising from use of the vehicle, including accidents, theft, legal violations, or fines incurred by the Customer or permitted drivers. CarTurf is not responsible for denial of insurance coverage due to Customer or driver actions, including failure to comply with insurance requirements or operating the vehicle outside insured regions.

In the event of non-payment and deregistration under Section 6, the Customer assumes full legal and financial responsibility for any costs incurred after the vehicle is deregistered and insurance coverage is discontinued.

8. Cancellation and Minimum Commitment

Either the Customer or CarTurf may cancel this Agreement at any time subject to this section. If the Customer cancels within the first six (6) months, the Customer agrees to pay the equivalent of six (6) months of service fees minus amounts already paid for months prior to cancellation.

Upon cancellation, CarTurf (and its partners) will no longer act as registered keeper, and the Customer is responsible for re-registering the vehicle or transferring registration. If the vehicle is not re-registered within a reasonable time, CarTurf may deregister the vehicle and notify relevant authorities, which may leave the vehicle unregistered and uninsured. All outstanding financial obligations, including insurance, taxes, and fines, must be settled before cancellation is finalized and registration documents are released.

9. Transition Assistance

If the Customer cancels the Services, CarTurf will assist in transferring vehicle registration to another entity or person and providing required information and documents, subject to applicable law. CarTurf may withhold cooperation until all outstanding payments (including taxes, insurance, and fines) are settled.

10. Ownership Affirmation

CarTurf acknowledges that the vehicle purchased by the Customer and registered through CarTurf remains the Customer's property. CarTurf will not claim ownership of the Customer's vehicle.

11. Vehicle Sales Assistance

CarTurf can assist the Customer in selling the vehicle after the Customer's use. This service is complimentary for Customers subscribed to the Autopilot tier or higher for at least twelve (12) months. Customers may sell independently. If the Customer sells through CarTurf without meeting the twelve-month requirement, CarTurf will charge a minimum fee of €500. If the vehicle sells for more than €10,000, an additional fee of one percent (1%) of the sale price is payable to CarTurf.

12. Costs and Operating Expenses

All operational vehicle costs remain the Customer's responsibility. CarTurf does not cover maintenance, fuel, or penalties incurred while the vehicle is owned by the Customer and registered through CarTurf, except as expressly stated in these Terms regarding administrative processing of notices.

13. Pricing Adjustments

CarTurf may modify service fees, including subscription fees and related charges, upon at least fourteen (14) days' written notice. If the Customer does not agree, the Customer may cancel in accordance with Section 8 before the new rates take effect. Continued use after the effective date constitutes acceptance of the new pricing. Insurance premiums and vehicle tax are set by insurers and authorities and may change independently of CarTurf's service fees.

14. Indemnification

The Customer agrees to indemnify, defend, and hold harmless CarTurf, its partners, directors, employees, and agents from and against claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of or in connection with the use, operation, registration, or insurance of the vehicle, or any breach of these Terms by the Customer or any permitted driver, including accidents, property damage, traffic violations, and failure to maintain required insurance or inspections.

15. Eligibility and Lawful Use

Anyone with a valid driver's license may use CarTurf, subject to these Terms and applicable law. The Customer must not use CarTurf to register a vehicle that the Customer intends to drive primarily in the country where the Customer is a resident, where local law disallows long-term use of foreign plates by residents. The Customer is responsible for complying with residency, immigration, customs, and vehicle-import rules in each country visited.

16. Data Privacy

Personal data is handled as described in our Privacy Policy and applicable data-protection law (including the GDPR where it applies). Driver and identity documents submitted under Sections 5.5 and 5.6 are processed for compliance with road-authority requests, fraud prevention, and contract performance.

17. Intellectual Property

All content provided by CarTurf is for personal, non-commercial use by the Customer in connection with these Terms and remains the property of CarTurf or its licensors. The carturf.app applications are developed and published by CarTurf Inc., a Delaware corporation; use of the apps may be subject to additional app-store and in-app terms.

18. Governing Law and Disputes

These Terms form an agreement with CarTurf Global FZCO, a free zone company established in Dubai, United Arab Emirates. These Terms are governed by the laws of the Emirate of Dubai and the applicable federal laws of the United Arab Emirates.

Any dispute arising out of or in connection with these Terms, including any question regarding their existence, validity or termination, shall be finally resolved by arbitration under the Arbitration Rules of the Dubai International Arbitration Centre (DIAC) in force at the time. The seat of arbitration shall be Dubai, United Arab Emirates, the tribunal shall consist of one arbitrator, and the language of the arbitration shall be English.

Registration, keeper, insurance and vehicle-tax acts performed by CarTurf's licensed partners in other countries, such as CarTurf UG (haftungsbeschränkt) in Germany, are carried out under the local law of the country where they are performed.

Nothing in this section deprives a Customer who is a consumer of the protection of any mandatory provisions of the law of their country of residence that cannot be excluded by agreement.
